In pondering my own question I found this odd statement from Intel...

Who or what given specification are they referring to??? And especially since Intel themselves show you how to use XMP ....

For me, reading the above, I believe the "void" statement indicates anything above the listed XMP specs of the RAM.

Notice the wording "may void any product warranties". Those are weasel words so the company is covered whenever they void a warranty.

For DDR4 any speed higher than 2133MHz is considrered being overclocked. So strictly speaking your warranty could be voided if you ran RAM higher than that. Since most non-OEM motherboards have settings for XMP or its equivalent then the warranty claim is meaningless.

There are a lot of ways to push your motherboard where you could potentially damage it. Overclocking is one way to do that. However, using XMP is not one that a manufacturer will ever be able to use to void your warranty.

A minor correction:

For Gen12, the maximum spec'd frequency for DDR4 is 3200MHz. For Gen13, it's the same.

The frequency limits I stated for DDR5 apply to the high-end models; lesser ones may be lower.

A lot of the story concerning Asus was due to the wording about warranty if using a beta BIOS that was available for download to fix the issues with voltage regulation on some boards with some Ryzen CPUs.
Since the issue was bought to the public eye Asus has changed thier approach, this has been reported by Gamers Nexus who followed the story through to conclusion and gave Asus a smiley face sticker for addressing the ambiguity.

It is not like other manufacturers did not have the same issues, MSI and Gigabyte for example, but they took a different approach from the start.
A lot of manufacturers have been called out over warranty concerns for different products due to ambiguous wording, not just in the tech space.

For those owning MSI boards I would be more concerned over the issues such as default BIOS settings turning off some security features and the leaking of private signed keys for the boot process, potentially affecting hundreds of board revisions currently in use.
Just an example of another manufacturer having thier own issues.

As far as XMP is concerned it has always been seen as an overclock by Intel, the JDEC listed speed of a memory module can be the same speed as some XMP profiles and is not treated as an overclock, making warranty concerns a confusing area for customers.

I'm aware of what the JDEC specs are. That said when you buy XMP certified RAM, you're not buying the JDEC specs, you're buying the "guaranteed" above JDEC spec'd RAM. The same RAM Intel is touting their processors support. The same RAM that if bought and does not work at those speeds will be replaced by the RAM vendor.

Certification Program
Memory vendors test their modules following Intel’s Intel® XMP test plans, in addition to their own. Test results are recorded along with the specific processor, motherboard, and BIOS version used. Once passing test logs are reviewed by Intel modules are considered for addition to the Intel® XMP certified list.

The Certified list says those modules will run at the XMP (overclocked above the JDEC specs) speed as certified by Intel and the vendor. That if you review the XMP 2.0 list you'll notice RAM modules listed as high as 5333Mhz, and speeds as high as 6400MHz for XMP 3.0.

So for me, this verbiage would mean anything above the XMP spec where "RAM" is concerned.

But yes, companies will try to weasel out of support if they can get away with it. Not so easy with an educated consumer.

Anyway, though I've never had to RMA a CPU, I did RMA a motherboard (Gigabyte), and RAM (Corsair). No voids there.

A lot depends on the quality of the Memory controller (IMC) on the processor. Also, the XMP can can depend on loose secondary and tertiary timings, which affects performance. In addition, the XMP might require high voltages to work, and that is a motherboard thing, so the motherboard may set very high voltages (VCCSA, etc.).

So for high frequency XMP, you might have a combination of motherboard, processor (IMC controller) and RAM that may not work. Good memory vendors will honor their warranty. I use g.skill because they have their own qualified motherboard list for a given RAM kit, and they will stand by it as far as I have seen ( I have never had an issue myself).

I have an ASUS Prime X370-Pro 1st generation AMD Ryzen motherboard. I wanted to upgrade the RAM to 32GB at 3200MHz. I didn't know which RAM to buy since the 1st generation Ryzen motherboards were picky with RAM. The G.SKILL RAM configurator only showed 32GB (2x16GB) DDR4 2933 RAM. I knew that the Flare X RAM was designed for AMD Ryzen so I took a chance with the following RAM. It works great at the rated 3200MHz.

Update for my problem in post #7 with Corsair ram not running at DDR5 5600, latest motherboard bios 1202 applied and now ram is working correctly at XMP 3.0

Yup. I just recently stated in another post here that ASUS is no longer what they used to be and I no longer recommend them to my clients. ASUS was known for quality components and for their Support. Well, their support is horrible now and the quality of their hardware is dubious. They are not nearly what they used to be. That has been my finding. That is my own personal opinion (based on experience). That is my view.

I just built a new PC with an ASUS Z790 board which is fine so far. Who is top dog now in your opinion?

Many people still have the same positive experience with ASUS that they were known for years ago. I'm not sure how true that is when it comes to Support and Customer Service. I'm glad you managed to dodge the sort of nightmare I experienced the last time I called ASUS. I concurr with Jayz and others who have tried to appeal to ASUS for support. Hopefully, you will never need it.

I mentioned in another one of my recent posts that GIGABYTE has been making a lot of progress lately. From things I've read their client support is good too. To be honest, I've never needed to call them. Every GIGABYTE board I've ever purchased has worked well right out of the box. I suppose it would really depend on what you use your PC for. MSI has eaten their fair share of humble pie in the past. Perhaps they have mended their ways. Here is what I do know: Corporations don't change unless their bottom line changes. When the profits increase they get sloppy and administration gets arrogant. Only when they start losing money do they get concerned. Suddenly customer satisfaction isn't just a pile of rhetoric. But to produce those sorts of results people have to STOP BUYING, no matter how good the product looks, no matter what lying reassurances they offer. The collective client base MUST make the share holders feel the consequences before they even lift a finger to mend their ways. It's all about the bottom line.

With Asus MB, your experience is usually very good. I buy them from Amazon or Microcenter where I can return in 30 days if there is something no functional. On the other hand, if you have an issue under warranty, it will almost certainly be a nightmare according to people that have had to. I would never buy a laptop from them for sure.

That Asus was the first laptop I ever owned (and still have). Anyway, it wasn't the laptop but the power brick that had an issue.

And like you, I too only do Amazon (not their marketplaces) and Microcenter for PC parts.

And I definitely agree sending an item back for warranty service is nightmare as you could end up getting a "refurb" back when you bought a new item. That's the one thing I fear when sending something back for repair - getting a refurb back
